1. What CountIn is

CountIn (countin.band, "the Service") prepares backing tracks for live performance. You add an audio file, CountIn detects its tempo and first downbeat, and you can add a synced count-in (hi-hat, open hi-hat, sticks or a spoken count, one to eight bars), an intro, a key change in semitones, and a split with the count-in on one channel and the music on the other. The Service also offers free tools such as the BPM finder, tap tempo and key changer.

There is no account. By using the Service you accept these Terms. They are available free of charge at this address and can be saved or printed.

2. What is free and what you pay for

Free, without limits: adding files, tempo and downbeat detection, all count-in, intro and key settings, and listening to the full result in your browser. Songs you add are kept in your browser's own storage for your next visit.

Paid: exporting, that is downloading the finished file (WAV or MP3). Export is unlocked by a plan. Stage is a yearly plan for exports with the count-in, intro clicks and key change. Click is a yearly plan that adds the click track through the whole song. Lifetime is a one-time payment for everything in Click, with no expiry for as long as the Service operates. The current prices are shown in the app and on the payment page before you pay, together with any taxes that apply. Every plan has unlimited exports. Promotional codes, when offered, lower the price of that purchase or of the first year of a plan.

Technical requirements: a current version of Chrome, Safari, Firefox or Edge with JavaScript enabled, an internet connection, and audio files in MP3, WAV, M4A, FLAC or OGG format up to 100 MB.

4. Refunds and the right of withdrawal

30-day money-back guarantee. If CountIn is not what you needed, write to support@countin.band from the email you paid with within 30 days of purchase, and you get a full refund, even if you have already exported files. No reason is needed. The refund goes back to your original payment method, normally within 14 days, and the access key is deactivated. The guarantee applies to the first payment of a plan and to a Lifetime purchase; a renewal can be refunded if you write to us within 14 days of it and have not exported files in the new year.

Consumers in the EU also have a statutory right to withdraw from a distance contract within 14 days. The 30-day guarantee covers that period and more, so in practice you can simply ask for a refund.

5. Complaints

If the Service or an exported file does not work as described, tell us at support@countin.band: the email you paid with, what happened, and if possible the file concerned. We reply within 14 days. If you are a consumer, you keep all remedies the law gives you for digital content that does not conform to the contract, including having it brought into conformity, a price reduction or ending the contract.

If we cannot agree, you may turn to a consumer ombudsman (miejski or powiatowy rzecznik konsumentów) or the Trade Inspection (Inspekcja Handlowa) in Poland, or to the consumer body in your own country. The EU online dispute resolution platform closed on 20 July 2025 and is no longer available.

8. Detection accuracy and availability

Tempo and downbeat detection are automatic and can be wrong, especially on songs with tempo changes, pickups or no clear drums. Every setting can be corrected by hand. Listen to the preview before you use a file on stage. We work to keep the Service available but cannot promise that it will run without interruption; maintenance and outages can happen.

9. Liability

If you are a consumer, nothing in these Terms limits the rights mandatory law gives you. If you use the Service for business, our liability is limited to the amount you paid, and we are not liable for lost profits or indirect loss. Songs kept in your browser can be removed by the browser or by clearing site data, so keep your own copies of files that matter.

10. Changes to these Terms

We may change these Terms for good reasons, such as a change in the law, new features or a change in how the Service is paid for. The current version and its effective date are always at this address, and significant changes are announced in the Service in advance. Changes do not take away export access you have already bought.

11. Law and disputes

These Terms are governed by Polish law. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you may bring a claim before the courts the law allows you to choose. The English version of these Terms is binding.
